1. Nature of Business & Direct Sales

ATMAX Equipment Co. manufactures and sells industrial MowerMax equipment directly from our Tampa factory.

• Government Contracts: We are a primary provider for municipal, state, and federal agencies. Sales are frequently governed by specific cooperative purchasing contracts (e.g., Sourcewell Contract #032525-AMX, BuyBoard Contract #706-23, and various State-level agreements). In the event of a conflict between these Terms and a specific Government Contract, the Government Contract terms shall prevail for that entity.
• Demonstrations: Requests for equipment demos are subject to regional sales rep availability and site suitability.

2. SMS & Mobile Messaging Consent

By contacting our sales department at (813) 634-1111 or reaching out to a regional representative, you expressly consent to receive SMS messages from ATMAX Equipment Co. for:

• Logistics & Delivery: Updates regarding factory-direct shipping, equipment delivery timelines, and freight coordination.
• Service Coordination: Scheduling factory-direct mobile service technicians for on-site maintenance or warranty repairs.
• Sales Support: Direct communication with your assigned regional sales representative regarding quotes and demos.
• Opt-Out: Reply STOP to cancel. Standard message and data rates apply.

3. Warranty & Factory Service

ATMAX Equipment Inc. stands behind the MowerMax product line with a comprehensive factory warranty.

• Service Model: Unlike traditional equipment brands that rely on third-party dealers, we service our products directly from our Tampa factory and through a fleet of factory mobile service technicians.
• Exclusions: Warranty coverage does not extend to damage resulting from unauthorized modifications, improper industrial use, or failure to follow the prescribed maintenance schedule.

4. Intellectual Property

MowerMax is a proprietary product line developed through seven years of research and development. All designs, including the western hemisphere’s first purpose-built boom mower, are protected under U.S. Patent and Trademark laws. Unauthorized reproduction is strictly prohibited.

5. Limitation of Liability

To the maximum extent permitted by law, ATMAX Equipment Co. is not liable for indirect, incidental, or consequential damages (including loss of municipal productivity) arising from equipment downtime. Liability is limited to the repair or replacement of defective parts as outlined in the specific warranty agreement.
